Customer Terms of Service

These terms apply to homeowners and other customers who use WorkWhale to discover and contact local professionals.

1. What WorkWhale Is

WorkWhale is a directory-style service discovery platform owned and operated by Insple LLC. The platform helps users discover, review, and contact local service providers (“Pros”).

WorkWhale and Insple:

Any agreement for services is solely between you and the Pro.

2. Acceptance of Terms

By accessing or using WorkWhale, you agree to these Customer Terms of Service and our Privacy Policy. These terms apply to all use of the platform, including browsing listings, submitting service requests, posting reviews, or contacting Pros.

3. Platform Role & No Guarantees

Insple and WorkWhale:

You are responsible for verifying a Pro’s identity, qualifications, and compliance with local regulations before hiring them.

4. Submitting Requests & Sharing Information

When you submit a request, message, or form through WorkWhale, you authorize Insple/WorkWhale to:

If you post reviews, ratings, photos, or other content, you represent that your content is truthful, based on your personal experience, and does not violate any law.

Insple and WorkWhale do not process payments and are not parties to any service agreement. All pricing, estimates, scheduling, payment arrangements, refunds, and contract terms are strictly between you and the Pro.

Insple is not liable for disputes, damages, or losses arising from services performed or not performed by any Pro.

WorkWhale is provided on an “as is” and “as available” basis. Insple disclaims all warranties, express or implied, including:

9. Limitation of Liability

To the fullest extent permitted by law, Insple LLC and its product WorkWhale are not liable for any indirect, incidental, special, punitive, or consequential damages, including lost profits, lost data, or loss of goodwill.

In all cases, the total liability of Insple and WorkWhale for any claim related to your use of the platform will not exceed $100.

You agree to indemnify and hold harmless Insple LLC and WorkWhale from and against any claim, demand, loss, or damage arising out of:

Insple may suspend or terminate your access to WorkWhale, remove content you have posted, or restrict features at any time if we believe you have violated these Terms, engaged in fraud or abuse, or created a risk for other users.

12. Dispute Resolution

Any dispute between you and Insple/WorkWhale arising out of these Terms or your use of the platform will be resolved through binding arbitration in Collin County, Texas, on an individual basis. Class actions and class-wide arbitrations are not permitted.

13. Changes to These Terms

Insple may update these Customer Terms from time to time. When we do, we will update the Effective Date above. Your continued use of WorkWhale after changes are posted constitutes your acceptance of the updated Terms.
